By using OffPeak, an app made by Atsumi Labs LLC, you agree to these terms. If you don’t agree, please don’t use the app.

The app

OffPeak displays live and day-ahead electricity prices (starting with ComEd’s hourly pricing program) and optional alerts, to help you decide when to use electricity. It is provided for general informational use.

Informational only — not billing or financial advice

OffPeak is provided “as is” and is not an official source of your electricity rate or bill. Prices can be delayed, estimated, or inaccurate, and the price shown is a market rate that may differ from what your utility ultimately bills. OffPeak is not affiliated with, and is not connected to, your utility account or meter. Don’t rely on OffPeak alone for billing, financial, or safety decisions; confirm rates with your utility.

Acceptable use

No warranties

OffPeak is provided “as is” and “as available”, without warranties of any kind, express or implied, including accuracy, fitness for a particular purpose, or uninterrupted availability.

Limitation of liability

To the maximum extent permitted by law, Atsumi Labs LLC is not liable for any indirect, incidental, special, or consequential damages, or for any decision made in reliance on the app (including higher-than-expected energy costs), arising from your use of OffPeak. Where the app is provided free of charge, our total liability is limited accordingly.

Changes & availability

We may change, suspend, or discontinue OffPeak at any time, and may update these Terms; when we do, we’ll change the “Last updated” date above. Your continued use after changes are posted means you accept the updated Terms.

Governing law

These Terms are governed by the laws of the State of Illinois, United States, without regard to its conflict-of-laws rules.
